Anyone who inherited a rustic or mixed land can benefit, until September 30, from the free identification and registration procedures through the simplified cadastral information system and the Single Property Counter (BUPi). Decree-Law No. 87/2026, of April 15, extended the exemption provided in Article 14 of Law No. 65/2019 until this date. The regime applies, as a rule, to properties with an area equal to or less than 50 hectares. The end of this deadline does not create an automatic fine, but it ends a temporary exemption, so postponing regularization may involve payment of fees, set at 250 euros for the special registration procedure, plus 50 euros for each additional property.
Identifying the land on BUPi and registering it at the Land Registry Office are different steps. Having the property record or tax assessment article at the Tax Authority does not replace registration. Identification can be initiated online or at a physical counter, with support from a qualified technician, but then registration at the Land Registry must be handled separately. In municipalities without cadastral records, identification is done through georeferenced graphic representation (RGG).
An inherited land may continue to be associated in records with the person who died. Regularizing ownership helps avoid difficulties in a future transfer. The free status may also cover certain simplified inheritance succession procedures carried out at the registry services, when necessary for the regularization of properties and the legal conditions are met. However, this does not mean that any deed or service related to an inheritance is automatically free.
The legislative amendment in April expanded the requirement to indicate the RGG number to documents that title transfers of ownership rights. The requirement also covers registrations of acquisition, annexation, and de-annexation of rustic and mixed properties. There are exceptions, such as when services confirm on BUPi that the RGG has already been submitted or that the property is inscribed on the cadastral map.
